License Terms (EULA)

License terms for the software “TalkPatch” (app and Stream Deck plugin) by Viktor Stark, starks.design, Reinhartserstraße 18A, 87437 Kempten, Germany (the “Licensor”). By installing or using the software you accept these terms. The Terms of Sale apply to the purchase.
1. Subject of the license
The software is a teleprompter for macOS with local speech tracking, camera and audio recording, remote and Stream Deck control, and a local control interface. It is not sold, it is licensed.
2. Right of use
- The Licensor grants you a simple, non-exclusive, perpetual right to install and use the major version of the software you bought.
- One license covers up to two Macs that you use yourself (in your own household or business). Activations can be moved to other devices in your customer account.
- Private and commercial use are both allowed, including use in videos, streams, podcasts and presentations created or delivered with the software. The Licensor acquires no rights whatsoever in the content you record with TalkPatch.
3. Restrictions
- No passing on, renting out, lending or publicly providing the license or the license key.
- No circumventing technical protection measures and no altering the license check.
- Decompilation and reverse engineering only to the extent that § 69e UrhG mandatorily permits.
- The “TalkPatch” trademark must not be used for your own products or services.
4. Free trial
Try TalkPatch free for 7 days with everything unlocked. Request the trial key in the app with an email address; one trial per email address and per Mac. After that TalkPatch is locked until a license is activated; your scripts and settings stay.
5. Updates and term
Updates within the major version you bought are included. New major versions may appear as a paid upgrade. The license runs indefinitely; it ends if you materially breach these terms and do not stop the breach after being asked to.
6. Local processing
The software processes camera, microphone, speech and text on your device. It transmits no content to the Licensor. An internet connection is needed to download the speech models the first time you switch them on and for any license activation or update check; details are in the Privacy Policy.
7. Third-party components
The software contains third-party components under their own licenses, which are not affected by these terms. The full license texts ship with the software.

The exact license details of the models are published by their respective providers (Hugging Face) and ship with the software. The providers’ terms of use apply to the models in addition.
8. Warranty and liability
Statutory warranty law applies. The Licensor is liable without limitation for intent and gross negligence as well as for injury to life, body or health; for simple negligence only for the breach of essential contractual obligations, limited to the foreseeable damage typical for this type of contract. Speech tracking is a reading aid; no particular recognition rate is warranted.
9. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as it does not deprive them of the mandatory protective provisions of their country of residence. If individual provisions are invalid, the rest remains in force.
